This End User License Agreement is a legal agreement between you and ARTJUNKIE Inc. regarding your use of ProductImage Pro. By downloading, installing, or using the App, you agree to be bound by this Agreement.
1. Grant of License
1.1 License Grant
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to: download and install the App on Apple devices you own or control; and use the App to process images.
1.2 License Restrictions
You may not: copy, modify, adapt, or create derivative works of the App; distribute, transfer, sublicense, lease, or lend the App; reverse engineer, decompile, disassemble, or attempt to derive the source code; remove, alter, or obscure copyright, trademark, or other proprietary notices; use the App in violation of applicable laws or regulations; or circumvent security features.
2. Intellectual Property
The App (including code, design, graphics, user interface, and documentation) is owned by ARTJUNKIE Inc. and protected by copyright, trademark, and other intellectual property laws. “ProductImage Pro” and the app logo are trademarks of ARTJUNKIE Inc. All rights not expressly granted in this Agreement are reserved by ARTJUNKIE Inc.
3. User Content
You retain all rights to the image files you process using the App. We claim no ownership of your content. You are solely responsible for: the content of your image files; confirming that you have the right to process the images; and complying with applicable laws regarding your image content. You agree not to use the App to process copyrighted material without permission, infringe the intellectual property rights of others, or create or distribute infringing content.
4. Pricing
The App is provided free of charge. There are no in-app purchases, subscriptions, or other paid features.
5. Third-Party Software
The App uses only Apple’s system frameworks (CoreGraphics, ImageIO, Core Image, Core Text, PDFKit, etc.) and the Swift standard library for image processing. All run locally on the device. The App does not bundle any third-party open-source libraries (all features, including ZIP export, are implemented independently). See Third-party Licenses for details.
6. Privacy
Your use of the App is governed by our Privacy Policy, which describes how information is collected, used, and protected. The Privacy Policy is incorporated by reference into this Agreement.
7. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranty of any kind, express or implied. We disclaim all warranties, including: merchantability; fitness for a particular purpose; non-infringement; accuracy or completeness; and uninterrupted or error-free operation. We do not warrant that the App will meet your requirements, is compatible with all systems, can process all image formats, or that processing quality meets any particular standard.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for: indirect, incidental, special, consequential, or punitive damages; loss of data, images, or content; loss of profits or revenue; business interruption; or damages arising from use or inability to use the App. Our total liability is limited to the amount you paid for the App (zero for a free app).
9. Indemnification
You agree to indemnify, defend, and hold harmless ARTJUNKIE Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from: your use of the App; your breach of this Agreement; your infringement of third-party rights; or content you process using the App.
10. Term and Termination
This Agreement is effective until terminated. You may terminate by deleting the App from all devices and ceasing use. We may terminate immediately if you violate any provisions. Upon termination, your license is revoked and you must delete all copies. Sections 2, 3.2, 7, 8, and 9 survive termination.
11. Updates and Changes
We may release updates for bug fixes, performance improvements, feature changes, or compatibility updates. We may modify this Agreement at any time. Continued use after changes constitutes acceptance of the updated Agreement.
12. Governing Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of Japan, regardless of conflict-of-law principles. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. 13. Apple-Specific Terms
You acknowledge that this Agreement is between you and ARTJUNKIE Inc. only, and not with Apple Inc. The license granted is limited to a non-transferable license to use the App on Apple products you own or control, as permitted by the App Store Terms of Service. ARTJUNKIE Inc., not Apple, is solely responsible for the App and any maintenance and support services. In the event of any failure to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligations. ARTJUNKIE Inc., not Apple, is responsible for addressing any claims relating to the App or its use, and for claims of intellectual property infringement. You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce its terms.
14. General Provisions
This Agreement constitutes the entire agreement between you and ARTJUNKIE Inc. regarding the App. If any provision is held invalid or unenforceable, the remaining provisions remain in full effect. Failure to exercise any right or provision does not constitute a waiver of that right or provision. You may not assign or transfer this Agreement without our prior written consent.
