Terms of Service

Article 1: General Provisions
These Terms of Service (the “Terms”) govern the use of DRIVE:ON RADAR (the “App”). By using the App, users agree to be bound by these Terms.
Article 2: Definitions

Service: Location tracking, chat, group functions, and other services provided through the App

User: An individual who downloads the App and creates an account

Content: Information, data, text, and messages posted, transmitted, or shared by users through the App

Subscription: Paid plans (Premium Mini, Premium, Premium Plus) and add-on options
Article 3: Account Registration
3.1 Eligibility
– Individuals aged 13 or older
– Ability to agree to and comply with these Terms
– Provision of accurate information
3.2 Sign-In Methods
The following sign-in methods are available:
– Sign in with Apple
– Sign in with Google
3.3 Account Management
– Users are responsible for the security of their accounts
– Do not share your password with third parties
– Immediately notify us if you suspect unauthorized access
3.4 Account Suspension and Deletion
We may suspend or delete accounts in the following cases:
– Violation of these Terms
– Confirmed unauthorized use
– Extended period of inactivity
Article 4: Use of Service
4.1 Location Tracking
– Location information is shared only with session participants
– Users can end sessions and stop location sharing at any time
– Location accuracy is not guaranteed
– Free plan limits 1-on-1 sessions to 10 minutes
4.2 Chat Function
– Sending inappropriate content is prohibited
– Messages are transmitted encrypted
– We do not monitor message content (except in cases of violation reports)
4.3 Voice Call Function
– Voice calls during sessions are provided through LiveKit
– Call quality depends on network conditions
– Call content is not recorded
4.4 Group Function
– Premium plan or higher is required to create groups
– Free plan and Premium Mini allow joining groups only
– Each group can have up to 8 members
– Group administrators can add and remove members
– The number of groups you can create varies by plan
Article 5: Prohibited Activities
Users must not engage in the following:
- Illegal Activities
– Acts violating laws, regulations, or ordinances
– Acts related to criminal activities
- Unauthorized Use
– Unauthorized use of others’ accounts
– Unauthorized access to systems
– Circumvention of security features
- Harassment
– Harassment, threats, or defamation of other users
– Spam, fraud, phishing
– Sending inappropriate content
– Stalking
- Commercial Use
– Unauthorized commercial use
– Advertising, promotion, or solicitation
- Reverse Engineering
– Analysis, decompilation, or modification of the App
– Use of third-party tools
- Providing False Information
– Registration with false information
– Impersonation
- Privacy Violations
– Unauthorized tracking of others’ locations
– Sharing location information with third parties without consent
Article 6: Subscriptions
6.1 Plan Types
Free Plan
– 1-on-1 location tracking (10 minutes)
– Basic chat features
– Join groups only
– Ads displayed
Premium Mini
Monthly: $1.99 / Annual: $14.99
– Unlimited friend location sharing
– Ad-free
– Join groups only (cannot create)
Premium
Monthly: $4.99 / Annual: $49.99
– Create 1 group (max 8 members each)
– Unlimited friend location sharing
– Unlimited chat
– Ad-free
Premium Plus
Monthly: $7.99 / Annual: $79.99
– Create 3 groups (max 8 members each)
– Unlimited friend location sharing
– Unlimited chat
– Ad-free
– 30-day location history
– Priority support
6.2 Add-on Options
Premium and Premium Plus users can purchase additional groups:
– +1 Additional Group: Monthly $2.99 / Annual $29.99
– +2 Additional Groups: Monthly $4.99 / Annual $49.99
– +3 Additional Groups: Monthly $7.99 / Annual $79.99
6.3 Billing and Payment
– Charges are billed through the App Store
– Subscriptions automatically renew
– Apple’s payment terms apply
– Prices are subject to change without notice
6.4 Cancellation and Refunds
– You can cancel your subscription at any time
– Cancellation is done through App Store subscription settings
– After cancellation, you can continue using the service until the end of the current billing period
– Refunds are not provided as a rule (except where required by law)
6.5 Plan Changes
– Plan upgrades take effect immediately
– Plan downgrades take effect from the next billing cycle
– Some features will be restricted when downgrading
– If the number of groups exceeds the new plan’s limit, excess groups will be deleted
6.6 Free Trial
– Some plans may offer a free trial period
– After the trial period ends, you will automatically transition to a paid plan
– If you cancel during the trial period, you will not be charged
Article 7: Intellectual Property Rights
7.1 Our Rights
– Copyright and trademark rights for the App and related content belong to artjunkie inc.
– Users may not reproduce, distribute, or modify without our permission
– The App logo, name, and design are our trademarks
7.2 User Content
– Users retain rights to content they post
– However, users grant us a license to use such content to the extent necessary to provide the Service
– We do not use user content for other purposes
Article 8: Disclaimers
8.1 Service Provision
– The Service is provided “as is”
– We do not guarantee completeness, accuracy, safety, or availability
– Service interruptions, errors, and bugs may occur
8.2 Limitation of Liability
We are not liable for:
– Disputes between users
– Damages due to inaccurate location information
– Damages due to service interruption or termination
– Failures of third-party services (Firebase, LiveKit, etc.)
– Issues with users’ devices or network environments
– Damages from misuse of location information
– Data loss or corruption
8.3 Cap on Damages
To the maximum extent permitted by law, our liability is limited to the amount paid by the user in the past 12 months.
8.4 Third-Party Services
This App uses the following third-party services:
– Firebase (Google LLC)
– LiveKit (LiveKit Inc.)
– Apple Push Notification Service
We are not liable for issues arising from these services.
Article 9: Service Changes and Termination
9.1 Changes
We may change, add to, or remove service content without prior notice.
9.2 Termination
– We may terminate the Service with 30 days’ notice
– Upon service termination, we may provide pro-rated refunds for unused subscription periods
9.3 Maintenance
We may temporarily suspend the Service for regular maintenance.
Article 10: Personal Information Handling
User personal information is handled in accordance with our separate “Privacy Policy.”
Article 11: Changes to Terms
We may change these Terms from time to time. For significant changes, we will notify users via in-app notification or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
Article 12: Governing Law and Jurisdiction
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan.
12.2 Jurisdiction
The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising from these Terms.
Article 13: Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Article 14: No Assignment
Users may not assign their position or rights and obligations under these Terms to third parties without our prior written consent.
Article 15: Notifications
We will notify users through the following methods:
– In-app notifications
– Email to registered email addresses
– Announcements within the App
